Article 1 – Residence contract
A.1.1 Legal regime:
The host signing this contract, concluded for a number of people, one or more rooms, for a fixed period.
This contract is subject to the status of guest houses. Consequently, the host cannot, on the one hand, avail himself of the legal provisions applicable to residential leases, namely that he may not under any circumstances avail himself of any right to remain in the premises at the - beyond the duration of the reservation; on the other hand, he is prohibited from any domiciliation in the residence on a private or professional basis.This ban on domiciliation makes it impossible for him to submit any request for housing assistance.
A.1.3 Responsibility:
The provisions of articles 1952 and following of the Civil Code relating to hoteliers are not applicable to "Chemin-maison d'hôtes Amboise". Its responsibility cannot be engaged in the event of theft or damage to personal effects, in the rooms, in the common premises, the car parks and all other outbuildings and annexes of the establishment.
In case of presentation of a number of people, children, babies higher than that mentioned during the booking confirmation, the owner can refuse the additional people. This refusal does not constitute cancellation of the reservation by the owner. In case of departure of more people than those refused, no reimbursement will take place.
Article 2 – Reservations
A.2.1 - Use of the reservation space:
The user must be at least 18 years old, be legally capable of contracting and using the site in accordance with the General Conditions of Sale. The user is financially responsible for his steps, except in the case of fraud, of which he is responsible for providing proof. He also certifies the veracity and accuracy of the information concerning him provided on the reservation space made available to him.
A.2.2 - Reservation formalities:
Reservations can be made by email, telephone or directly online via the website www.maison-chemin.fr
The reservation will be effective when the host has sent the owner a deposit of 50% of the total amount of the price of the stay. Prices are inclusive of all charges, excluding tourist tax. Following payment, the guest will receive a booking confirmation by email which will contain the essential elements such as their contact details, identification of the service(s) ordered, the date of stay and the price.
By paying the deposit, the host confirms his full and complete agreement with the general conditions of this document.
The payment of the balance is paid at the entrance to the premises.
For reservations made by mail, telephone or internet and in accordance with the regulations in force (articles L.121-20-2, L.121-20-4 and L.121-21-8 of the consumer code) , the host is informed that he does not benefit from the right of withdrawal attached to distance selling.
Article 3 – Cancellations
A.3.1 - By the host:
The cancellation must be communicated by email, mail or telephone.
In the event of cancellation of the reservation, cancellation compensation is collected automatically and without formalities by "Chemin-maison d'hôtes Amboise", in the following cases and conditions:
In case of cancellation more than 15 days before the date of arrival, the cancellation is made free of charge.The deposit is fully refunded within one month of the date of cancellation.
In case of cancellation less than 14 days before the date of arrival, the deposit paid remains acquired.
In the event of cancellation less than 48 hours before the date of arrival: the deposit paid remains acquired and we reserve the right to claim the balance of the amount of the accommodation.
In case of cancellation the same day, the entire stay is due.
In case of early departure: the price of the entire stay remains fully acquired.
Failure to arrive in the event of no cancellation is deemed to be a "no show": in this case, the entire stay is due.
Depending on the case, the owner reserves the right to claim the balance due from the host.
A.3.2 By the owner:
In the event of cancellation on the part of the owner, the latter informs the host and immediately pays him all the sums paid.No compensation will be received for any reason and in any form.
Article 4 – Rates and means of payment
All the prices of the services which are communicated on the booking page are mentioned in Euros (€), including VAT (all taxes included) and excluding local and tourist taxes.
Breakfasts are included in the room rates, no reduction will be applied if the breakfasts are not consumed.
The tourist tax collected by the municipality is fixed by the latter and is to be paid directly on site. The tourist tax at the Chemin house is 80 cts per person per night.
The prices presented on the reservation space can be modified at any time, without notice. These changes are not applicable for reservations already confirmed.
The means of payment accepted are credit cards and cash.
Article 5 – Arrival and departure
Arrivals are on the day mentioned on the booking confirmation, no earlier than 5 p.m. and no later than 9 p.m. In case of late or deferred arrival, the host must imperatively notify by telephone.
For the tranquility of our guests, we will not accept arrivals after 10 p.m.
The owner is not obliged to accept the host on the spot in case of advance.
Departures are at 11 a.m. at the latest.
Article 6 – Pets
In respect of the tranquility of the place, pets are not allowed. No derogation possible.
In the event of non-compliance with this clause, the owner's refusal to accept guests and their animals cannot be considered as a modification or breach of contract at the initiative of the owners. So that in case of departure of the host, no refund can be considered.
Article 7 – Use of premises
Only accommodated people can stay in the property. It is forbidden for people staying or staying to invite outside people.
In order to guarantee the tranquility of the place and your comfort, you agree to respect the rules of art of living laid down in these T&Cs and recalled in the room(s) you occupy, namely that:
The entire house, including the bedrooms, is non-smoking.
It is forbidden to consume food in the rooms.
Guests undertake to return the room(s) used in the state in which they took possession of them and to systematically declare any damage. Any missing or degraded object will be charged to the host.
The common areas such as the kitchen and the breakfast room with billiard room are available free of charge to guests and it is requested that they be cleaned and/or tidied up after use.
Minors and particularly young children are placed under the full and sole responsibility of their parents or persons having authority over them.
It is requested not to throw anything else in the toilets than the toilet paper provided. The sanitation system by micro wastewater treatment plant is autonomous and cannot accept tampons, wipes, sanitary napkins, condoms, etc.
We thank hosts for not downloading illegally.
Article 8 – Forgotten objects
Any object forgotten during a stay may be returned to its recipient subject to the prior payment of the shipping costs.
Article 9 – Respect for privacy
In accordance with the Data Protection Act of January 6, 1978 amended by Law 2004-801 of August 6, 2004, the user has, at any time, a right to access, modify, rectify and delete data. that concern him.He can exercise it subject to proving his identity by sending us a letter to the following address: Chemin-maison d'hôtes, 63 route de chenonceaux, 37400 Amboise.
The user also has a right of opposition to the processing of his data for legitimate reasons as well as a right of opposition to this data being used for commercial prospecting purposes.
The reservation space is regularly declared to the CNIL. The information communicated by the user on the reservation space makes it possible to process and execute his orders. This information is essential and mandatory in the pages of the reservation area. This space is managed by the company Elloha SAS, registered with the RCS of Perpignan under the number 837856806 and whose registered office is located at 4, rue Cité Bartissol in Perpignan;the user authorizes Elloha SAS to communicate his personal data to third parties on the condition that such communication proves to be compatible with the performance of the operations incumbent on Elloha SAS under these general conditions and in connection with the customer charter for the protection of personal data. In particular when paying online, the customer's bank details must be transmitted by the payment provider stripe.com to the bank of the establishment, for the execution of the reservation contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection within the meaning of the Data Protection Act. However, the customer agrees to this transfer necessary for the execution of his reservation. Constellation SAS / Stripe.com in their professional capacity, have undertaken vis-à-vis the establishment to take all security and data confidentiality measures for said data transfers.
The entry of the required banking information, as well as the acceptance of these general conditions and the voucher or the reservation request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized records kept in the computer systems of elloha.com. will be kept under reasonable security conditions and considered as proof of communications, orders and payments between the parties. The customer is informed that his IP address is registered at the time of booking.
